Campbell charters the ship "Asia" from Holliday & Co, and induces Allanson & Co to give a promissory note for $1010 to Holliday & Co to secure the advance on account of the vessel required by them: Campbell to secure the payment of Allanson & Co both of the promissory note so given on his account to Holliday & Co by Allanson & Co and also of a previous balance of $300 due by him to Allanson & Co agrees with the privity and consent of De Lacy that the Bill of lading of 2000 bags of rice shall be handed by Holliday & Co to Allanson & Co on condition of the latter duly honouring the promissory note given by them to the former on his (Campbell's) account.
This condition Allanson & Co comply with, Campbell on his voyage to Bally and from thence by mistake instructs Messrs Holliday & Co to hand the bill of lading of the rice to De Lacy. Holliday & Co being aware of Allanson & Co's claims give notice to them of the instructions and Allanson & Co claim the rice in accordance with their agreement with Campbell and De Lacy insists on its being delivered to him in accordance with Campbell's letter of instructions. The result has been that the rice has not been delivered to either party and that Holliday & Co make a heavy charge upon it for warehouse rent and other expenses.
